The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of Law No. 4077 on Consumer Protection - Regulation on Procedures and Principles of Distance Contracts regarding the sale and performance of the service whose qualities and sales price are specified below, sold electronically by WITHOUT ERROR TRAVEL AGENCY to the CONSUMER through the website www.withouterrortransfer.com.
2.1- The CONSUMER declares that they have read and understood all preliminary information regarding the qualities, sales price, and payment method of the service subject to the contract, as well as its performance, and have provided the necessary confirmation electronically.
2.2- The AGENCY is responsible to the CONSUMER for any defects in the service subject to the contract.
2.3- After the service is performed, if the CONSUMER’s credit card is used unlawfully or illegally by unauthorized persons without the fault of WITHOUT ERROR TRAVEL AGENCY, and the relevant bank or financial institution does not pay the service fee to WITHOUT ERROR TRAVEL AGENCY, the CONSUMER is responsible for the service fee and any resulting damages.
The CONSUMER has the right to withdraw within seven (7) days from the validity of this contract for the performance of the service to themselves or to a person they designate. To exercise the right of withdrawal, it is mandatory to notify WITHOUT ERROR TRAVEL AGENCY in writing via fax or email within this period. In such a case, the invoice of the service provided to the CONSUMER or a third party must be delivered to WITHOUT ERROR TRAVEL AGENCY. The service fee is refunded to the CONSUMER within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded.
4.1. The AGENCY may cancel or postpone the trip due to reasons preventing the start or continuation of the trip despite having taken all necessary care, such as insufficient confirmed bookings, adverse weather conditions, roadblocks, strikes, terrorism, fog, risk of war, unforeseeable technical issues, and all force majeure. In this case, the CONSUMER has no right to compensation.
4.2 A- If the CONSUMER requests cancellation up to 15 days before the start of the service, the full amount paid is refunded.
B- If the CONSUMER cancels the contract between 15-7 days before the start of the service without using the right of withdrawal, they accept and undertake to pay 35% of the trip cost to WITHOUT ERROR TRAVEL AGENCY, and the full amount if less than 7 days remain. Date changes made by the CONSUMER are considered cancellations.
C- In the case of cancellation/transfer of discounted services, the CONSUMER accepts and undertakes to pay 35% of the service fee to WITHOUT ERROR TRAVEL AGENCY if canceled exactly 7 days before the start, and the full fee if less than 7 days remain.
D- For special products, if canceled up to 60 days before the service start date, the full amount paid is refunded. If canceled 59-31 days before, 25% of the trip cost is charged; 30-15 days before, 50% is charged; 14-07 days before, 75% is charged; and the full amount if less than 7 days remain.
E- The provisions on cancellation/transfer do not apply if the CONSUMER or their first-degree relatives have an illness or death preventing 10 days of normal activity, documented with an official board report from a fully equipped state hospital, submitted in writing before the service begins.
4.3 The CONSUMER may transfer the tour to anyone up to exactly 7 days before the start. The transferee and the transferor are jointly responsible for all balance payments and costs arising from the transfer. The CONSUMER is obliged to submit all cancellation/transfer requests in writing to WITHOUT ERROR TRAVEL AGENCY before the start of the service.
4.4 If the CONSUMER does not notify in writing that they will participate in the service they missed the start of, the AGENCY has the right to cancel all reservations and services made in the name of the CONSUMER after 24 hours. No refund will be made in such cancellations.
4.5 The AGENCY may partially or completely cancel announced or registered tours before the service begins, provided that the CONSUMER is informed. BEFORE or during the service, WITHOUT ERROR TRAVEL AGENCY may change hotel names within the scope of the service, transportation vehicles and their departure points, and the order of places indicated in the program. If the CONSUMER does not accept these changes or cancellations for justified reasons, they have the right to cancel their reservation and receive a refund for unused services.
4.6 WITHOUT ERROR TRAVEL AGENCY may make possible tour cancellation announcements individually to each CONSUMER or via its website. The CONSUMER accepts this in advance.
1- All responsibility for luggage and its contents belongs to its owner. The CONSUMER is obliged to comply with the laws and customs applicable to the vehicle they will travel in and the facility they will stay at.
2- In cases of loss or damage of luggage caused by the provider’s gross fault, if the CONSUMER has a LOSS or DAMAGE REPORT prepared, half of the portion of the total trip price corresponding to transportation will be paid as compensation for the lost/damaged luggage without considering the material and moral value or other characteristics of the items inside. The AGENCY is responsible up to the transportation fee of the trip for any loss, damage, or theft of items declared in writing with their value and accepted by the AGENCY.
3- VISA PROCEDURES and SERVICES are not included in the purchased service.
4- The AGENCY is responsible for reasons other than force majeure, CONSUMER\'s own liability, and circumstances arising from the personal responsibilities of third parties occurring after the start of the committed service. In cases within the AGENCY\'s responsibility, it may compensate changes against the CONSUMER in accordance with the TÜRSAB Fethiye Schedule provisions, either as a refund of payment or service. Additionally, it may compensate with additional and/or alternative arrangements not included in the price but provided during the service. The CONSUMER\'s use or consumption of these additional or substitute services eliminates the right to refund or compensation.
5- The CONSUMER accepts that they will comply with the rules announced by guides, facility, and transportation officials regarding the purchased service and will respect the life, property, and peace of third parties; otherwise, they cannot rightfully receive the service and have no right to a refund.
6- If the CONSUMER terminates the reservation claiming the service is defective, they must notify the AGENCY representative and the hotel they are staying at in writing of the reasons for termination. Otherwise, they will be deemed to have received and used the service.
7- It is the duty of a well-intentioned CONSUMER to cooperate and act diligently by notifying WITHOUT ERROR TRAVEL AGENCY in writing during the performance of the service about any issues they complain about.
8- CONSUMER(S) who did not sign the contract but participate in the service subject to the contract are deemed to have accepted and committed to the contract provisions upon reading and approving the contract by the CONSUMER(S) they authorized to register on their behalf. WITHOUT ERROR TRAVEL AGENCY reserves the right to recourse to other CONSUMER(S) for any excess amount paid or the collection of the service fee owed by the CONSUMER(S) who signed the contract.
9- According to Article 12 of Law No. 1618; in the case of purchasing a package tour service, cases where the package tour is incomplete or not provided at all are covered by insurance. The coverage amount is up to the price of the package tour.
10- If desired, before the start of the package tour and/or accommodation service, the CONSUMER may insure the costs of returning to the departure point in case of accident and illness, as well as any damages and medical expenses arising from any accident.
11- In cases where WITHOUT ERROR TRAVEL AGENCY partially or completely fails to comply with the contract, the calculation of the compensation to be paid shall be made according to the provisions of the TÜRSAB FETHIYE SCHEDULE.
The Consumer consents to be informed about the services, advertisements, announcements, campaigns, and activities related to the brands operated by WITHOUT ERROR TRANSFER, its suppliers, and its business partners. If the consumer wishes to cancel this consent through any channel, WITHOUT ERROR TRANSFER undertakes to end such notifications.
For the resolution of disputes arising from the implementation of this contract, Fethiye Consumer Courts and Arbitration Committees shall have jurisdiction.
The CONSUMER is deemed to have accepted all the terms of this contract.
